1 Introduction

1.1 These Terms and Conditions (Terms) sets forth the Terms and Conditions under which RENTWARDS Pty Ltd (Rentwards, we, our or us) provides you access to, and governs your use of, the website located at rentwards.com.au (Site) and the information, content, features, products and services provided through the Site (together with the Software, collectively, the Service).

1.2 By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or otherwise use our Site or Service or any information contained herein.

1.3 These Terms and Conditions are effective from the date specified above.

1.4 We reserve the right, at our discretion, to modify these Terms from time to time, which modification will be effective upon the posting of the changes to our Site, and will apply to causes of action arising after the effective date of the change. You should continue to check the Site for changes. Your continued use of our Site or otherwise the Service we provide following the posting of changes to these Terms will mean that you accept those changes.

1.5 Your use of the Site and/or the Service, or by clicking "I accept" if presented with these Terms in a click-through and/or checkbox format, signifies your agreement to these Terms and constitutes your binding acceptance of these Terms, including any changes that we make to these Terms. If you do not agree to this, you may not use the Site or the Service.

1.6 By accessing or using our Site or Service, you represent and warrant that you can form a binding contract with us.

1.7 By using our Site and/or Service, you represent that you have read and consent to our Privacy Policy in addition to these Terms. We may make changes to the Privacy Policy at any time, and any changes will be posted to the Site. If you do not agree to any clauses of the Privacy Policy, you must immediately stop using the Site and/or the Service.

1.8 The headings and captions used in these Terms are inserted for convenience only and will not affect the meaning or interpretation of these Terms.

1.9 If there is a conflict of clauses within these Terms, the more stringent clause takes precedence and effect.

2 The Services

2.1 The Rentwards Site and/or Service is a rewards program that provides users/members with redeemable rewards for paying their rent. Users/members earn Rentwards points every month for paying rent and users/members can use Rentwards points to redeem rewards listed on our Site and/or Service.

2.2 We are not a travel company, mortgage broker or financial institution. Our Site and/or Service is an administrative platform that lists rewards from third parties.

2.3 We reserve the right to add, change, modify, suspend or discontinue any portion of the Site and/or Service, at our sole discretion, at any time. Your use of the Site and/or the Service, including the availability of new services through the Site, shall be subject to these Terms. In addition, Rentwards may impose limits on any portion of the Service or restrict your access to portions of the entire Site and/or Service at our sole discretion without notice or liability.

2.4 We will not be liable for any delay in performing any of our obligations under these Terms.

2.5 To be eligible to use our Site and/or Service, you must be 18 years of age or older.

2.6 To be eligible to use our Service, you must be a paid member. In the event that you cancel and/or do not pay for your membership, your access to our Service will be revoked immediately.

3 Limitation of Liability

3.1 To the maximum extent permitted by law, the Site and/or Service is available "As Is".

3.2 You expressly understand and agree that your use of the Site and/or Service including the redemption of any rewards are all at your sole risk. The Site and/or Service is provided on an "As Is" and "As Available" basis. Rentwards expressly disclaims all warranties and conditions of any kind, whether express or implied, including but not limited to the implied warranties and conditions of fitness for a particular purpose and non-infringement.

3.3 You expressly understand and agree that Rentwards does not warrant that:
(i) the Site and/or Service will meet all of your requirements;
(ii) the Site and/or Service will be uninterrupted, timely, secure or error free; or
(iii) all errors in the Site and/or Service will be corrected.

3.4 You expressly understand and agree that any material downloaded or otherwise obtained through the use of the Site and/or Service is done at your own discretion and risk, and you are solely responsible for any damage to your computer or other devices for loss of data resulting from the download or use of any such material.

3.5 You expressly understand and agree that no advice or information, whether oral or written, obtained by you from Rentwards or from the Site and/or Service shall create any warranty and/or guarantee not expressly stated in these Terms. You expressly understand and agree that, except for any damages resulting from a data breach related to the personal data collected by the Site, Service, Rentwards, its subsidiaries, affiliates and our respective officers, directors, employees, agents and successors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages or loss of profits, money, goodwill, use, data or other intangible losses (even if Rentwards has been advised of the possibility of such damages) resulting from:
(i) the use or inability to use the Site and/or Service;
(ii) unauthorised access to or the loss, corruption or alteration of your communications, transmissions, user content or data;
(iii) statements or conduct of any third party on or using the Site and/or Service, or providing any services related to the operation of the Site and/or Service;
(iv) Rentwards’ actions or omissions in reliance upon your information and any changes thereto or notices received therefrom;
(v) your failure to protect the confidentiality of any information you provide to us;
(vi) the acts or omissions of any third party using or integrating with the Site and/or Service;
(vii) the termination of your use and access to the Site and/or Service in accordance with the conditions of these Terms; or
(viii) any other matter relating to the Site and/or Service.

3.6 In any event and without limiting the generality of this section to the extent permitted by law you agree that our total liability to you for all damages and losses shall not in any circumstances exceed $100.

3.7 If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

3.8 If we do not exercise or enforce any right or provision under these Terms, it will not constitute a waiver of such right or provision. Any waiver of any provision under these Terms will only be effective if it is in writing and signed by us.

3.9 If any part of these Terms is found to be void, unlawful or unenforceable then that part will be deemed to be severable from the balance of these Terms and the severed part will not affect the validity and enforceability of any remaining provisions.

3.10 You agree that no joint venture, partnership, bond, employment, or agency relationship exists between you and Rentwards as a result of these Terms or your use of the Site or the Service.

3.11 Our failure to enforce any provision of the Terms shall in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by us of any provision, condition or requirement of the Terms shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

3.12 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RENTWARDS OR ANY OF ITS AFFILIATES, TOGETHER WITH ITS RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES AND AGENTS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR:
(i) ANY LOST OR CORRUPTED DATA, LOST PROFITS, LOSS OR DAMAGE TO ANY COMPUTER, MOBILE PHONE OR OTHER DEVICE OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO OR USE OF THE SITE AND/OR THE SERVICE, EVEN IF RENTWARDS AND/OR ITS AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;
(ii) THE USE OR THE INABILITY TO USE THE SITE AND/OR THE SERVICE;
(iii) YOUR INABILITY TO REDEEM REWARDS OFFERED ON THE SITE AND/OR SERVICE;
(iv) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
(v) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE AND/OR SERVICE;
(vi) ANY OTHER MATTER RELATING TO THE SITE OR THE SERVICE; OR
(vii) THE COST OF PROCURING SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY.

TO THE FULL EXTENT PERMISSIBLE UNDER APPLICABLE LAW, RENTWARDS’ AGGREGATE LIABILITY TO YOU OR ANY THIRD PARTY IN ANY CIRCUMSTANCE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE REMEDY FOR ANY PROBLEMS OR DISSATISFACTION WITH THE SITE OR ANY PORTION OF THE SERVICE IS TO DISCONTINUE YOUR USE OF THE SITE AND THE SERVICE.

3.13 The Site and/or Service, including without limitation, the Rentwards website or app, Rentwards points, rewards, benefits, offers and discounts, are provided “as is” and “as available” and without warranty of any kind, express or implied.

3.14 Neither the Site and/or Service nor the Rentwards points and/or rewards offered by us creates, constitutes or gives rise to any legal or contractual rights by members against Rentwards. A member’s use of the Site and/or Service is solely at the member’s own risk.

4 Submitted Documentation

4.1 As part of our Site and/or the Service we provide, we may request that you submit information and/or documentation such as your full name, your residential address including detailed information about your residence, the amount you pay for rent, information about your employment status including your salary and/or wage, financial information about you such as any investments you have, any loans, debts or repayments you make, your credit history, your spending habits, information about your family such as the dependants you may have, information about any future home loans you are looking for, proof of payment documents, receipts, text, photos, audiovisual content, and other forms of documentation. By providing any form of documentation to us, you are granting Rentwards a license to use the documentation provided in order to make our Site and/or Service available to you.

4.2 When you submit any form of documentation to us, you acknowledge and agree that:
(i) the documentation you submit does not contain confidential or proprietary information;
(ii) Rentwards is not under any obligation of confidentiality, express or implied, with respect to any documentation provided to us; and
(iii) Rentwards shall be entitled to use or disclose such documentation submitted to us for any purpose, in any way, in order to provide you with our Service.

4.3 You are solely responsible for any documentation you submit to Rentwards and the consequences of submitting, posting or publishing it.

5 Content Disclaimer

5.1 You understand that when using the Site and/or Service, you will be exposed to user content and third party content from a variety of sources, and that Rentwards is not responsible for the accuracy, integrity, quality, legality, usefulness, safety, or intellectual property rights of or relating to such user content or third party content. You further understand and acknowledge that you may be exposed to user content and third party content that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Rentwards with respect thereto. Rentwards does not endorse any user content or third party content, or any opinion, recommendation, or advice expressed therein. Under no circumstances will Rentwards be liable in any way for or in connection with any user content or third party content.

6 Third Parties' Links, Websites, and Services

6.1 The Site and/or Service may contain images and links to third-party websites, brands, retailers, advertisers, services, or other events or activities that are not owned or controlled by us. We are not affiliated with those websites, do not endorse them, have no control over those websites, and assume no responsibility and/or liability for the content, privacy policies, or practices of any third-party websites. In addition, we will not and cannot censor or edit the content of any third-party site.

6.2 If you access any third party’s website, service, or content from our Site and/or Service, you do so at your own risk. By using the Site and/or Service, you expressly release Rentwards from any and all liability arising from your use of any third-party website, information, materials, products or services.

6.3 You understand and agree that the information and/or documentation that you submit to us will be sent to third party companies when you redeem rewards on our Site and/or Service. If you do not agree to us submitting your information and/or documentation to third party companies, please do not use our Site and/or Service.

6.4 As part of our Service, you may be provided with information, offers and documents from third party companies for the purpose of providing you with rewards. By redeeming rewards offered by third party companies, you enter into an agreement directly with the third party company and do so at your own risk. You expressly release Rentwards from any and all liability arising from you redeeming and/or accepting any rewards from third party companies.

6.5 The content and information on our Site and/or Service cannot be treated as as professional financial, tax or legally binding, and you agree that Rentwards shall not be held liable for any decisions made by you in reference or reliance with any information or content you are access on our Site and/or Service. We do not provide professional advice and you must liaise with relevant qualified professionals in any field before making any decisions when accessing our Site and/or Service.

7 Changes to our Service

7.1 We reserve the right to make any changes (whether material or otherwise) to the Site and/or the Service, including but not limited to:
(i) the amount of Rentwards points you earn each month;
(ii) changes to our membership cost;
(iii) changes to the amount of Rentwards points required to redeem rewards; and
(iv) changes to the rewards offered, including the availability of rewards.

7.2 We reserve the right to discontinue or modify any aspect of the Site and/or Service at any time without notice to you.

8 Memberships

8.1 In order to use our Site and/or Service:
(i) You must be a current paying member of our Site and/or Service;
(ii) You must have paid all your membership fees up to date;
(iii) You must be paying rent for the residential property you are currently residing in;
(iv) You must be paying rent for a property in Australia;
(v) You must provide true, accurate, current and complete information when signing up for our Site and/or Service;
(vi) You must be at least eighteen (18) years of age; and
(vii) You must be a legal resident of Australia.

8.2 In order to become a member on our Site and/or Service, you will be required to provide information regarding your credit card or other payment method. You represent and warrant to us that such information is true, current and accurate and that you are authorised to use the applicable payment method.
8.3 Rentwards uses third-party payment processing partners for membership fees collected on our Site and/or Service, and you acknowledge that by signing up to become a member on our Site, you agree to the processing, use, transfer or disclosure of data by our third-party payment processing partners pursuant to these Terms as well as any and all applicable terms set forth by our third-party payment processing partners.

8.4 You understand and agree that we may use information regarding transactions you make on third party cards that you link as part of our Site and/or Service to track and monitor your activity on the card in order to identify, track and record transactions such as your rental payments in order for you to receive Rentwards points and rewards as part of our Site and/or Service.

8.5 When you sign up to become a member of Rentwards, you will be charged the membership amount monthly on a recurring basis to the payment details you have provided us. We reserve the full right to change the period which your membership fee is due.

8.6 You agree that all membership payments made on our Site and/or Service are final and will not be refunded.

8.7 You must not chargeback and/or request a refund for any membership payments you make on our Site and/or Service. If you do not agree to this, you may not use the Site and/or Service.

8.8 Only individuals are eligible to use the Site and/or Service, and each individual may maintain only one membership and/or account.

8.9 You may only use our Site and/or Service for personal use only. You may not use our Site and/or Service for commercial use.

8.10 If you cancel your membership with us and/or fail to pay the monthly membership fee at any point in time:
(i) You will immediately lose access to your account;
(ii) Your account will be deleted;
(iii) All Rentwards points earned will be deleted and removed from your account; and
(iv) Any rewards which you have redeemed but have not yet received will not be honoured and cancelled.

8.11 We reserve the full right at our discretion to terminate your membership, account and/or access to our Site and/or Service and remove all Rentwards points earned by you, if:(i) You fail to and/or do not pay your monthly membership fee at any point in time; or
(ii) You request a chargeback and/or refund of any membership fees; or
(iii) We suspect that you are engaging in dishonest and/or fraudulent activity; or
(iv) We suspect that you have sold and/or transferred Rentwards points to others; or
(v) You cannot provide proof that you have paid rent for the residence you are currently residing in; or
(vi) You have breached any clause of these Terms; or
(vii) We suspect that you have misused our Site and/or Service; or
(viii) We suspect that you are using our Site and/or Service for commercial purposes; or
(ix) We suspect that you are using another person’s name and/or details to create a Rentwards member account; or
(x) We suspect that you have made multiple accounts and/or are repeatedly opening or otherwise maintaining more than one membership account with us; or
(xi) We suspect that you are sharing your account with others; or
(xii) We believe that you are not eligible to hold a membership account with us for any reason whatsoever; or
(xiii) You are not paying rent for a property located in Australia.

8.12 We reserve the full right to reject, revoke, suspend or terminate any membership at any time with immediate effect and without written notice to you, if we believe you have breached any clause of these Terms and/or are not deemed to be a customer we would like to offer our Site and/or Service to.

8.13 Upon the termination of your membership account for any reason, you will lose all Rentwards points immediately regardless of how and/or when they were acquired.

8.14 By providing your personal details when signing up to become a member, you are providing us, our partners and affiliates your express consent to access your information in order to provide you with our Service, marketing materials and promotional offers suited best to your needs.

8.15 You agree and authorise us or our service providers to obtain your financial statements and/or reports in order to service your account and provide our Service to you.

8.16 We are not responsible for any disputes arising from unauthorised access of your account. It is your responsibility to keep your account information secure. Rentwards will not be liable for any loss or damage arising from your failure (whether intentional or unintentional) to keep your account information secure.

8.17 You agree and understand that certain features of the Site and/or Services including certain rewards and/or benefits may require or involve the use and dissemination of your personal information. If you do not agree to this, we are unable to provide you with access to any Services and/or rewards that require your personally identifiable information.

9 Rentwards Points

9.1 You will earn a set number of Rentwards points at the start of each month that you are an active paying Rentwards member and pay rent for a property located in Australia. Free Rentwards accounts will not earn any Rentwards points.

9.2 We reserve the full right to nominate how many Rentwards points you earn each month.

9.3 We reserve the full right at our discretion to change the amount of Rentwards points you earn each month at any time of our choosing. If you do not agree with or are not satisfied with the revised amount of Rentwards points you earn each month, please immediately stop using our Site and/or Service and immediately cancel your membership.

9.4 Rentwards points cannot be sold and/or transferred to others. If we believe that you have sold and/or transferred Rentwards points to others, your account will be banned and all your Rentwards points will be deleted.

9.5 Rentwards points cannot be sold and/or exchanged for physical monies and/or real life currency.

9.6 Rentwards points will be considered to be earned when posted to your member account.

9.7 We may provide you with a way to earn bonus Rentwards points such as special promotional offers or by buying items listed on our Site and/or Service which allows you to earn Rentwards points.

9.8 Once you use your Rentwards points to redeem rewards, the transaction is considered final and may not be cancelled unless otherwise noted by us.

9.9 Your Rentwards points do not expire as long as your membership account with us is open, active and all membership fees are paid up to date, however you will lose all your Rentwards points if you have breached any clauses of these Terms or if you close your account.

9.10 We reserve the full right at our sole discretion to make corrections to your Rentwards points balance:
(i) When you have been credited Rentwards points that you were not eligible for; or
(ii) When you have been credited an incorrect number of Rentwards points to your account; or
(iii) When you have been deducted an incorrect number of Rentwards points from your account when redeeming rewards.

If you suspect that an error has been made with regard to your Rentwards points balance, you are to immediately notify us of such errors.

9.11 We do not allow negative Rentwards points balances on any accounts. You must not redeem any rewards which will put your account into a negative Rentwards points balance.

9.12 We, in our sole discretion, determine how Rentwards points may be awarded, used or redeemed through the Site and/or Services.

9.13 You will lose all your Rentwards points earned to date immediately from the time you close your account and/or your account is closed by us for any reason whatsoever. Once you lose your Rentwards points, you will not be able to get your Rentwards points back again.

10 Changes To This Agreement

10.1 We may make changes to the Site and/or Service at any time and at our sole discretion, including but not limited to:(i) Prohibiting you from using any of the features of our Site and/or Service; or
(ii) Temporarily or permanently prohibiting you from earning Rentwards points; or
(iii) Prohibiting you from using Rentwards points you may have earned; or
(iv) Changes to how you earn Rentwards points; or
(v) Changes to how you can use Rentwards points; or
(vi) Changes to the expiry of Rentwards points; or
(vii) Changes to what rewards you can redeem with Rentwards points; or
(viii) Changes to the cost of the Rentwards membership.

10.2 We reserve the full right to terminate, modify, expire, or restrict any aspect of our Site and/or Service including but not limited to:
(i) How you earn and use Rentwards points; or
(ii) Cancellation of your membership and/or account with or without cause; or
(iii) Removal of any and/or all rewards offered on our Site and/or Service.

10.3 If we decide to cancel our Site and/or Service, you will have thirty (30) days to use your Rentwards points from the date we cancel the Site and/or Service. If you do not use your Rentwards points within this time, you will lose all Rentwards points.

10.4 We will provide you notice of changes to this agreement by posting a revised set of Terms on our Site and/or emailing notice of changes to you. The changes to this agreement will come into immediate effect from the time we post a revised set of Terms on our Site and/or email notice of changes to you. It is your responsibility to keep your contact information current and up to date.

11 Rewards

11.1 As part of our Site and/or Service, we provide rewards which can only be redeemed with Rentwards points by Rentwards members with an active account.

11.2 Minimum and maximum amounts apply to the amount of Rentwards points you can use to redeem rewards. The amount of Rentwards points required to redeem any reward is set by us at our sole discretion.

11.3 When redeeming rewards, you may be asked to present proof of payment evidence showing that you have been paying rent. If you are unable to provide evidence that you have been paying rent, you will deemed to be in breach of these Terms and will not be able to redeem rewards on our Site and/or Service.

11.4 The rewards displayed on our Site and/or Service can only be redeemed by using Rentwards points.

11.5 All rewards provided on our Site and/or Service are provided “as is” and “as available” without warranty of any kind, express or implied.

11.6 The rewards displayed on our Site and/or Service are limited in the amount and/or stock available and is provided on an "As Available" basis. Whilst rewards may be listed on our Site and/or Service, this does not mean that the rewards are in stock and/or available.

11.7 You agree and understand that redeeming a reward on our Site and/or Service does not form a contractual obligation for us to provide a reward to you, but is only a signal of your intent to redeem a reward.

11.8 Redeeming a reward on our Site and/or Service only signifies your intent to redeem that particular reward subject to availability. Only when we contact you by email notifying you that your reward has been successfully redeemed, will it mean that you will be receiving the reward you redeemed.

11.9 We will only deduct Rentwards points from your account when you have been notified by us that you have successfully redeemed your reward.

11.10 There is no guarantee, and nothing stated in the Terms, Site and/or Services that constitutes a guarantee that you will be able to redeem any particular reward for any particular amount of Rentwards points.

11.11 We reserve the full right at our discretion to change the types of rewards we offer on our Site and/or Service. You understand and agree that we can make these changes at any time. You understand and agree that we won’t provide notice to you regarding any changes we make to the types of rewards we offer on our Site and/or Service. Your continued use of our Site and/or Service after we make changes signifies your acceptance of such changes.

11.12 We, in our sole discretion, determine how Rentwards points may be awarded, used or redeemed through the Site and/or Services and we reserve the full right to reject the redemption of rewards with Rentwards points at any time of our choosing.

11.13 If you have redeemed rewards with Rentwards points that you were deemed ineligible to receive, Rentwards reserves the full right to invoice you for the amount of the rewards you redeemed with Rentwards points that you were deemed ineligible to receive. We reserve the full right to collect any monies owing to us and reserve the full right to commence legal proceedings against you to recover the cost of any rewards you redeemed with Rentwards points that you were deemed ineligible to receive.

11.14 Rewards provided on our Site and/or Service is provided by third party companies. You agree and understand that when you redeem a reward, you will subject to the terms and conditions and privacy policies of third party companies. By redeeming rewards offered by third party companies, you enter into an agreement directly with a third party company and do so at your own risk. You expressly release Rentwards from any and all liability arising from you redeeming and/or accepting any rewards from third party companies, including any disputes that may arise.

11.15 You agree and understand that you are responsible for determining, reporting, filing and paying all taxes and duties in connection with any rewards that you redeem on our Site and/or Service.

11.16 Rentwards Rent Week rewards are limited in the number of stock and/or quantity we provide. We reserve the full right at our discretion to nominate how many Rent Week rewards we offer to Rentwards members. The Rentwards Rent Week rewards can only be redeemed by entering into a draw where one (1) Rentwards member will be chosen at random to redeem the reward offered as part of the Rentwards Rent Week rewards program. The Rentwards Rent Week reward draw can only be entered by paying Rentwards members and the reward offered can only be redeemed using Rentwards points.

11.17 The Rentwards Rent Week rewards draw allows Rentwards paying members to have an equal opportunity at redeeming our in-demand rewards which we offer from time to time without having to compete against bots and/or other unfair practices which may disadvantage Rentwards members from redeeming the Rentwards Rent Week rewards. Rentwards makes no warranty that we will continue to offer the Rentwards Rent Week rewards program on an ongoing basis and reserve the full right to terminate the Rentwards Rent Week rewards program.

11.18 Rentwards reserves the full right at our discretion to choose and/or nominate the time frame from you receiving confirmation that your reward has been successfully redeemed and/or you have successfully transferred your Rentwards points into a reward, to the actual time frame when you actually receive your reward. Rentwards will not be held to any time frames with regards to providing you with rewards. Where Rentwards has provided a time frame of when you will receive your rewards, this is only an indicative time frame which we make no guarantee and/or promises to and is not a legally binding date.

11.19 Rentwards reserves the full right to cancel, at any time, any reward that has been redeemed:
(i) Where the amount of Rentwards points required to redeem a reward was subject to an error on the Site, for example, the incorrect amount of Rentwards points required to redeem a reward was listed on the Site; or
(ii) Where the description of the reward listed on the Site was subject to an error and/or incorrect; or
(iii) If Rentwards believes you have not complied with these Terms and/or the requirements set out by Rentwards.

11.20 When a reward you redeem is cancelled, Rentwards will not deduct any Rentwards points from your Rentwards points balance.

12 Flight Rewards

12.1 Flight rewards listed on our Site and/or Service can only be redeemed with Rentwards points and a valid member account.

12.2 When redeeming flight rewards with Rentwards points, you will be provided with flight credits in the form of flight credit dollars or gift card vouchers direct from the airline you have selected to redeem flight credits from. The flight credits are only valid for use at the airline which you have selected to redeem flight credits from.

12.3 Flight credits will be provided to you in the currency that the airline you select predominantly uses and/or trades in. If you receive a flight credit voucher to an airline that does not predominantly trade in Australian Dollars, conversion rates will apply for converting Australian Dollars (AUD) into the currency of choice of the airline you are redeeming flight rewards from.

12.4 When redeeming flight rewards, minimum and maximum Rentwards points may apply. We will let you know about any minimum or maximum amounts, as well as any additional terms and conditions, before you use your Rentwards points.

12.5 You must make yourself aware of any expiry dates of any flight credits provided to you. Rentwards will not be liable for any losses or damages arising from you not understanding that flight credits may have any expiry date.

12.6 By redeeming flight credits, you enter into an agreement directly with the third party airline company and do so at your own risk. You expressly release Rentwards from any and all liability arising from you redeeming and/or accepting flight credits from third party airline companies.

12.7 When you redeem and receive flight credits, you are bound to the terms and conditions and the privacy policies of the airline company. You understand and agree that you must make yourself aware of the terms and conditions and the privacy policies of the airline company prior to redeeming flight credits.

12.8 Redemption values for flight rewards vary. The latest redemption value for flight credits will be listed on our flight rewards page.

12.9 We reserve the full right, at any time of our choosing, to amend the amount of Rentwards points required to redeem flight credits. We will let you know about any amendments to the amount of Rentwards points required to redeem flight credits, before you use your Rentwards points.

13 Mortgage Rewards and Mortgage Credits

13.1 Mortgage rewards and/or mortgage credits listed on our Site and/or Service can only be redeemed with Rentwards points and a valid member account.

13.2 Mortgage credits can only be redeemed when you sign up to a home loan directly with Rentwards approved third party merchants and/or mortgage brokers.

13.3 Mortgage credits can only be used towards the reduction of your overall loan amount. When you successfully sign up to a home loan with Rentwards approved third party merchants and/or mortgage brokers, you can use your mortgage credits to reduce the overall loan amount.

13.4 Mortgage credits will only be redeemed and applied when you have successfully signed up to a home loan with Rentwards approved third party merchants and/or mortgage brokers.

13.5 When redeeming mortgage credits, minimum and maximum amounts may apply. We will let you know about any minimum or maximum amounts, as well as any additional terms and conditions, before you use your Rentwards points.

13.6 You agree and understand that when redeeming mortgage credits, you must provide personal information about yourself in order for us to provide with you with our mortgage credits Service. If you do not provide us with all information that is requested of you when redeeming mortgage credits, you will be deemed ineligible to redeem mortgage credits.

13.7 You understand and agree that if you do not receive approval for a home loan with Rentwards approved third party merchants and/or mortgage brokers, you will not be able to redeem mortgage credits.

13.8 By redeeming mortgage credits, you enter into an agreement directly with the third party merchant and/or mortgage broker and do so at your own risk. You expressly release Rentwards from any and all liability arising from you redeeming and/or accepting mortgage credits from third party merchants and/or mortgage brokers.

13.9 When you redeem and receive mortgage credits, you are bound to the terms and conditions and the privacy policies of the third party merchant and/or mortgage broker. You understand and agree that you must make yourself aware of the terms and conditions and the privacy policies of the third party merchant and/or mortgage broker prior to signing up to a home loan and redeeming mortgage credits.

14 Assignment

14.1 Rentwards reserves the right, in its sole and absolute discretion, to transfer, assign, sublicense or pledge in any manner whatsoever, any of its rights and obligations under these Terms to a subsidiary, affiliate, successor thereof or to any third party whatsoever, without notifying you or receiving your consent. You shall not transfer, assign, delegate, sublicense nor pledge in any manner whatsoever, any of your rights or obligations under these Terms.

15 Indemnity

15.1 You agree to defend, indemnify and hold harmless us, our affiliates, and our and their respective owners, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to legal fees) arising from:
(i) Your use of the Site and/or Service; or
(ii) Your violation of these Terms and the Privacy Policy; or
(iii) Your violation of any third-party right, including without limitation any copyright, property, publicity or privacy right including all actions taken under your account; or
(iv) Your violation of any applicable law; or
(v) Your negligence or wilful misconduct.

This defence, hold harmless and indemnification obligation will survive any termination of these Terms and your use of the Site and/or Services.

16 Unauthorised Use

16.1 You agree not to use the Site and/or Service or any aspect or feature thereof for any unlawful purpose or in any way that might harm, damage, or disparage any other party. Without limiting the preceding sentence, you agree that you will:
(i) Review and comply with these Terms and the Privacy Policy;
(ii) Comply with all applicable laws, including, without limitation, anti-money laundering laws, privacy laws, intellectual property laws, tax laws, and regulatory requirements;
(iii) Provide accurate information to us and update it as necessary;
(iv) Act honestly and in good faith; and
(v) Use the Site and/or Service for personal use only.

16.2 By using the Site and/or Service you agree not to:
(i) Create an account on behalf of anyone other than yourself; or
(ii) Attempt to use another person’s identity or create a false identity; or
(iii) Create multiple accounts and/or repeatedly open or otherwise maintain more than one membership account with us; or
(iv) Use the Site and/or Service for commercial and/or business purposes; or
(v) Provide false, incomplete, misleading or dishonest information when signing up for and/or using our Site and/or Service; or
(vi) Use our Site and/or Service for any activities that would constitute criminal activity; or
(vii) Infringe or use our brand, logos or trademarks in any business name, email, or URL except as expressly permitted by us; or
(viii) Use bots or other automated methods to access the Site and/or Service; or
(ix) Engage in any action that directly or indirectly interferes with the proper working of or places an unreasonable load on the Site's infrastructure; or
(x) Interfere or disrupt or game the Site and/or Service; or
(xi) Otherwise violate the Terms.

17 Disclosure

17.1 We reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to:
(i) Provide you with our Site and/or Service, including providing you with the ability to earn Rentwards points, verifying that you are eligible to earn Rentwards points and to provide you access to rewards; or
(ii) Satisfy any applicable law, regulation, legal process or governmental request; or
(iii) Enforce these Terms, including investigation of potential violations of it; or
(iv) Detect, prevent, or otherwise address fraud, security or technical issues; or
(v) Cooperate with law enforcement authorities; or
(vi) Respond to user support requests; or
(vii) Protect our, our users’ or the public’s rights, property or safety.

18 Intellectual Property

18.1 The interfaces, content, arrangement and layout of the Site including, but not limited to, the Rentwards trademark and logo, designs, text, artwork, graphics, images, buttons, user interfaces, information and other content, and any compilation of the foregoing (Rentwards Intellectual Property) are the property of Rentwards, except where otherwise noted, and are protected from copying, imitation, communication, or simulation under Australian and international laws and may not be reproduced, modified, communicated, displayed, distributed, or transmitted without the prior written permission of Rentwards.

18.2 You understand and acknowledge that, by visiting the Site, you do not acquire or obtain by implication or otherwise, any license or right to use or make additional copies of any materials or information displayed on the Site. You agree not to display or use any Rentwards Intellectual Property or third party content located on the Site in any manner not expressly permitted under these Terms.

19 General
‍
19.1 Interpretation: In these Terms and Conditions, unless the contrary intention appears:
(i) The singular includes the plural and vice versa;
(ii) Dollars or '$' means Australian dollars;
(iii) Unless otherwise stated, all dollar amounts include any applicable GST;
(iv) A reference to 'include' or 'including' means 'including but not limited to'.

19.2 Governing Law: The Terms and Conditions are governed by and will be construed in accordance with the laws of the State of New South Wales, Australia. In any action or other legal process with respect to any matter or thing in connection with these Terms and Conditions, you agree to submit to the non-exclusive jurisdiction of the State of New South Wales.

19.3 If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
